Terms of Service

1. Acceptance of Terms
By accessing or using ProConnekts ("the Platform"), operated by ProConnekts LLC, a Florida limited liability company ("ProConnekts," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform.
These terms apply to all users of the Platform, including homeowners ("Consumers"), home service providers ("Providers"), and administrators.
2. Description of Service
ProConnekts is a smart home service lead dispatch and marketplace operating system. The Platform:
- Captures homeowner service requests from multiple channels.
- Qualifies requests using automated scoring and classification.
- Matches requests to licensed, local service providers in Southwest Florida (Lee County and Collier County β Fort Myers, Cape Coral, Lehigh Acres, Bonita Springs, Estero, Naples, Marco Island, and surrounding areas).
- Dispatches leads via SMS and enforces response SLAs.
- Tracks provider performance and measures ROI by city and category.
ProConnekts is a marketplace platform, not a service provider. We connect Consumers with Providers but do not perform, guarantee, or warrant any home services.
3. User Roles & Accounts
3.1 Consumers (Homeowners)
- May submit service requests without creating an account.
- Must provide accurate contact information and a truthful description of the work needed.
- Acknowledge that ProConnekts does not employ, endorse, or guarantee any Provider.
3.2 Providers (Home Service Businesses)
- Must create an account and complete the onboarding process.
- Must hold all required licenses and insurance for their trade in the State of Florida.
- Must maintain accurate profile information, including service categories, coverage area, and contact details.
- Are responsible for responding to leads within the SLA window defined by their subscription tier.
- Agree to have their response rate, close rate, and customer reviews tracked for lead routing purposes.
3.3 On-Platform Communication (Required)
All initial customer contact, scheduling, and messaging for a ProConnekts-sourced lead must take place through the ProConnekts platform β via the in-app dashboard, SMS relay, or platform-routed phone bridge.
Specifically, for any lead introduced through ProConnekts, Providers must not:
- Solicit, request, or share personal phone numbers, email addresses, social media handles, or external links with the homeowner before the first ProConnekts-routed call or message.
- Encourage the homeowner to cancel their ProConnekts request and rebook directly, or to use a different platform.
- Save a ProConnekts-introduced homeowner's contact information for the purpose of soliciting future business outside of ProConnekts.
- Circumvent the success fee by completing a ProConnekts-sourced job under a different business name, invoice, or payment channel.
ProConnekts logs and audits messages relayed through the platform and call bridges placed via the dashboard. Repeated attempts to bypass on-platform communication are grounds for routing penalties, account suspension, or termination at ProConnekts' sole discretion, and may forfeit any accumulated referral credits or founding-tier rates.
For clarity: after a job has been completed and recorded in ProConnekts, the homeowner and Provider may choose to share contact information directly for future, unrelated work. This clause governs the first lead introduction only.
4. Subscriptions & Billing
4.1 Free Trial
Every new Provider receives a 30-day free trial with full Starter-level access. No credit card is required to start the trial. At the end of the trial, Providers must select a paid plan to continue receiving leads.
4.2 Paid Plans
- Starter ($99/mo): Up to 15 leads/month, 10-minute SLA, standard profile.
- Growth ($199/mo): Up to 40 leads/month, 5-minute SLA, priority routing, verified badge.
- Pro ($399/mo): Unlimited leads, instant dispatch, premium placement, dedicated account manager.
4.3 Billing Terms
- All plans are billed monthly through Stripe.
- In addition to the monthly subscription, Providers pay a success fee on each completed job sourced through ProConnekts β 5% (Starter), 3% (Growth), 2% (Pro) of the final job amount β billed via Stripe once the paid subscription is active (after the free trial).
- You may upgrade, downgrade, or cancel at any time. Changes take effect at the next billing cycle.
- Failed payments may result in account suspension. Providers with suspended accounts will not receive new leads.
- Refunds are handled on a case-by-case basis.
5. Lead Routing & SLA
- Leads are matched using an automated algorithm that considers service category, location, response rate, close rate, and subscription tier.
- Hot leads not viewed within 5 minutes may be reassigned to a backup provider.
- Hot leads not contacted within 10 minutes may be fully reassigned.
- ProConnekts does not guarantee a minimum number of leads. Lead volume depends on consumer demand in your service area.
- Only leads actually dispatched to you count toward your monthly lead limit.
6. Automated Services
ProConnekts uses automated technology (powered by OpenAI) to:
- Score and classify incoming service requests.
- Conduct automated qualification via voice calls and SMS.
- Determine the best provider match based on scoring algorithms.
Automated outputs are used as decision-support tools. ProConnekts reserves the right to override automated recommendations when necessary for quality and safety.
7. Communications
7.1 SMS Messaging (TCPA & Florida FTSA)
By using ProConnekts and providing express written consent at signup, you agree to receive SMS messages from ProConnekts LLC and matched parties, including messages sent using automated technology (an autodialer).
- Message types: Lead alerts, status updates, scheduling, follow-ups, and trial / billing reminders.
- Frequency: Variable β typically up to 10 messages per service request.
- Reply STOP to unsubscribe. Reply HELP for help.
- Standard message and data rates from your wireless carrier may apply.
- Consent to receive marketing messages is not a condition of using the Platform or receiving services.
7.2 Voice Calls & Call Recording
ProConnekts uses automated voice technology to qualify service requests, and offers a click-to-call bridge that connects homeowners and providers through a platform-owned phone number. Voice calls placed or received through ProConnekts may be recorded.
Florida is a two-party (all-party) consent state under F.S. 934.03 for the recording of wire and oral communications. By placing or accepting a call through the ProConnekts call bridge or virtual receptionist, you consent to the recording of your voice and the contents of the call by ProConnekts LLC for quality, training, fraud prevention, dispute resolution, and compliance. If you do not consent to recording, do not place or accept calls through the Platform.
Recordings are stored securely and retained for up to 90 days unless an active dispute or legal hold requires a longer retention period.
7.3 Email
You may receive account notifications, billing receipts, and marketing emails from ProConnekts. Every marketing email includes a one-click unsubscribe link as required by CAN-SPAM.
8. Reviews & Content
- Consumers may leave reviews for Providers after job completion. Reviews must be honest and based on actual experience.
- Reviews are subject to moderation. We may remove reviews that are fraudulent, abusive, or violate these terms.
- Providers may not incentivize, manipulate, or suppress reviews.
- By submitting content (reviews, gallery images, profile text), you grant ProConnekts a non-exclusive, worldwide license to display that content on the Platform.
9. Prohibited Conduct
You agree not to:
- Provide false or misleading information.
- Use the Platform for any unlawful purpose or to facilitate unlicensed work.
- Interfere with the Platform's operation, security, or other users' experience.
- Scrape, harvest, or collect data from the Platform without written consent.
- Circumvent the Platform to contact Providers or Consumers outside of ProConnekts for transactions initiated through it.
- Submit fake service requests or spam the lead system.
10. Trust & Safety
ProConnekts maintains a trust and safety reporting system. Users may report concerns about Providers, Consumers, or content. Reports are reviewed by our team and may result in warnings, suspension, or removal from the Platform.
11. Limitation of Liability
ProConnekts is a lead marketplace platform. We are not responsible for:
- The quality, safety, or legality of services performed by Providers.
- Disputes between Consumers and Providers.
- Any damages arising from the use of or inability to use the Platform.
- Accuracy of automated scores, classifications, or recommendations.
To the maximum extent permitted by law, ProConnekts's total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless ProConnekts, its officers, directors, employees, and agents from any claims, losses, or damages arising from your use of the Platform, your violation of these terms, or your violation of any third-party rights.
13. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, including for violation of these terms. Upon termination, your right to use the Platform ceases immediately. Providers may cancel their subscription at any time from their dashboard.
14. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of Lee County, Florida.
15. Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Platform constitutes acceptance of the revised terms.
16. Independent Contractor Relationship
Providers are independent third-party home service businesses, not employees, agents, partners, joint venturers, or contractors of ProConnekts LLC. ProConnekts does not direct, control, supervise, or set prices for the services Providers perform. Providers are solely responsible for their own licenses, insurance, taxes, employees, equipment, safety practices, scope of work, and the quality of the services they deliver. Nothing in these Terms creates an agency or employer-employee relationship between ProConnekts LLC and any Provider or Consumer.
17. General Provisions
17.1 Entire Agreement
These Terms, together with the Privacy Policy and any other policies referenced here, constitute the entire agreement between you and ProConnekts LLC and supersede all prior or contemporaneous understandings.
17.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision will be modified only to the minimum extent needed to make it enforceable.
17.3 No Waiver
Our failure to enforce any right or provision of these Terms does not waive that right. Any waiver must be in writing and signed by an authorized representative of ProConnekts LLC.
17.4 Force Majeure
Neither party is liable for failure or delay in performance caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, hurricanes, pandemics, government actions, labor disputes, power or internet outages, third-party service provider failures (carriers, hosting providers, payment processors), or war.
17.5 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. ProConnekts LLC may assign these Terms to a successor entity without restriction.
